Land use battle in Bellmore

The rights to develop a 17-acre parcel in Bellmore that has been at the center of a legal fight over building and zoning rights since 2005 belong to a developer, a judge has ruled.

Judge rules company has right to develop

The ruling called unconstitutional and void the town's attempts to mandate use of the land by rezoning it from single-family to mixed use.

A community should have the right to dictate what is built in their backyard.

Bellmore is not located in Queens. It is a town right next to Merrick on Long Island.
